Potentially.
Working under another party’s contract does not automatically mean you are insured under that party’s insurance.
Independent contractors and consultants can still be responsible for their own technology services and professional work.
What can the contract require? #
A contract may require you to:
- Maintain your own Professional Indemnity Insurance
- Maintain Public Liability Insurance
- Provide a Certificate of Currency
- Maintain insurance for a period after the work is completed
- Accept particular indemnity obligations
- Meet specified insurance limits
Am I covered under the principal’s insurance? #
Possibly, but this should be confirmed rather than assumed.
Questions to consider include:
- Are you actually an insured under the policy?
- Are your services covered?
- Are there subcontractor exclusions?
- What limit applies?
- What excess applies?
- Does the contract still require your own insurance?
