In South Australia, Building Indemnity Insurance provides statutory protection for homeowners and eligible future owners where covered domestic building work is incomplete or defective and the builder dies, disappears or becomes insolvent.
It is arranged for eligible domestic building work where the statutory requirements apply.
Contract Works Insurance #
Contract Works Insurance generally protects insured construction works, materials and other insured property against specified physical loss or damage during construction.
Examples can include:
- Fire
- Storm
- Theft
- Malicious damage
- Accidental damage
subject to the policy terms.
Public Liability Insurance #
Public Liability Insurance generally addresses certain legal liabilities for third-party personal injury or property damage arising from insured business activities.
How might they apply to the same project? #
For example:
- A storm damages an unfinished house — Contract Works may be relevant.
- A visitor is injured at the construction site — Public Liability may be relevant.
- The builder becomes insolvent and cannot complete eligible South Australian domestic building work — Building Indemnity may be relevant to the homeowner.
Public Liability can sometimes form part of a Contract Works policy.
Building Indemnity remains a separate statutory arrangement with its own eligibility and certificate process.
