Not in the same way as Contract Works Insurance.
Design and Construct Professional Indemnity Insurance is primarily concerned with liability arising from professional services.
It is not generally intended to insure physical loss or damage to construction works caused by events such as:
- Fire
- Storm
- Theft
- Malicious damage
- Accidental damage during construction
These risks are generally considered under Contract Works Insurance.
Can physical damage still form part of a Professional Indemnity claim? #
Yes, depending on the circumstances.
For example, a claim may involve physical damage or rectification costs arising from an alleged:
- Design error
- Incorrect specification
- Engineering error
- Consultant design error for which the contractor is responsible
- Professional advice error
The important distinction is the cause of the claim.
Professional Indemnity generally requires a connection with insured professional services. It does not ordinarily respond simply because workmanship is defective or construction work needs to be corrected.
Public Liability, Contract Works and Design and Construct Professional Indemnity each address different exposures.
