A threat of legal action, demand for compensation or allegation that your work caused loss should be reported promptly, even if it is informal.
It may constitute a claim or a circumstance that could develop into a claim.
What should I do? #
If you receive a threat, complaint or demand:
- Notify Webber Insurance promptly
- Keep all emails and letters
- Retain contracts and relevant records
- Make written notes of telephone conversations
- Do not admit liability
- Do not agree to make a payment
- Do not agree to settle the matter
- Avoid appointing lawyers or incurring substantial costs without checking with us or the insurer
- Take reasonable steps to prevent further loss where appropriate
Depending on the policy, notification requirements and timing can be important.
This is particularly relevant for claims-made policies such as many Professional Indemnity and Management Liability policies.
Early notification also allows the insurer to consider how the matter should be managed before it develops further.
