Public Liability Insurance can protect a Construction Contractor against certain claims alleging that its business activities caused third-party personal injury or property damage.
What claims can arise? #
Examples include:
- Damage to a client’s or neighbouring property.
- Injury to a visitor or member of the public.
- Damage caused while working at another premises.
- Incidents involving materials, equipment or subcontracted work.
- Completed-work or product-related allegations, where covered.
Cover remains subject to the insured activities, exclusions, limits and policy conditions.
Does it cover the construction works? #
Not generally. Physical loss or damage to the works, materials and project property is usually considered under Contract Works Insurance.
Are employee injuries covered? #
Public Liability is not a replacement for Workers Compensation. Employers must follow the requirements applying in their state or territory.
What about subcontractors? #
Disclose subcontractor use and payments accurately. A contractor may still face allegations arising from subcontracted work, depending on the contract and circumstances.
Subcontractors should generally maintain their own suitable insurance, but their policy does not automatically protect the principal contractor.
Does Public Liability cover design? #
Generally not. Design, advice and professional services may require Professional Indemnity or Design and Construct Professional Indemnity Insurance.
