Construction contracts can impose insurance obligations that are broader than a contractor’s usual policy. The contract should be reviewed before it is signed and before work starts.
Common insurance requirements #
A contract may specify:
- Public Liability, Contract Works, Professional Indemnity, workers compensation, motor or plant insurance
- minimum limits and how long cover must remain in place
- named insureds, interested parties or principals
- cross-liability, waiver of subrogation or contractual liability provisions
- cover during defects liability or maintenance periods
Clauses dealing with indemnities, fitness for purpose, warranties, consequential loss and responsibility for subcontractors can materially affect risk. A Certificate of Currency confirms limited policy information only and does not prove that every contractual requirement is covered.
